Article 1 – ORDER OF REPAIR
The repair order signed by the customer includes an indication of the nature of the operations to be carried out at the customer's request and the estimate of the cost of the repair before dismantling the vehicle. But examination of the vehicle may reveal the need for further work. The work performed by CMS corresponds to the signed repair order. CMS undertakes to carry out this work in accordance with the technical recommendations of the vehicle manufacturer.
Article 2 – QUOTATION
At the customer's express request, assuming an in-depth diagnosis of the vehicle with possible disassembly and reassembly of some of its components, an estimate may be established by CMS. When the estimate is payable, the customer will be informed prior to its establishment.
Article 3 – ACCESSORIES – PETROL
Upon receipt of the vehicle at the workshop, the customer will have the option of drawing CMS's attention to any particular element mounted on his vehicle or to any other point that he deems useful to point out. CMS is only responsible for the accessories and devices attached to the vehicle and the objects entrusted to its store after inventory, as well as the quantity of gasoline, noted when the vehicle enters the workshop.
Article 4 – CUSTODY OF THE VEHICLE – REMOVAL
In accordance with common law, CMS is liable for damage caused to the vehicle during the period of custody. The apparent condition of the vehicle upon receipt is mentioned on the repair order. CMS undertakes to return the vehicle in the state of cleanliness in which it received it.
Article 5 – WITHDRAWAL
The sending of the invoice or any other warning (sms, emails, messages) constitutes the provision of the finished vehicle. In the event of non-removal within 10 working days, the vehicle will be considered to be in custody at the customer's expense. The costs amount to €5 including VAT per day after this period.
Article 6 – SPARE PARTS
If the repair order mentions the delivery to the customer of the replaced parts, these will be returned to him at the time of delivery of his vehicle. If the replaced parts are not taken back by the customer at the time of delivery of his vehicle, CMS may dispose of them freely.
Article 7 – ACCEPTANCE OF WORKS
CMS explains the repairs carried out. Any anomaly of which CMS would be aware during the delivery of the vehicle and not having been the subject of a repair order will be reported to the customer and will be mentioned on the invoice. In the event that the customer refuses to remedy immediately any anomaly having an impact on the safety of the vehicle and which is reported to him by CMS, he undertakes to sign a waiver of liability with us.
Article 8 – INVOICING – PAYMENT
Repair invoices are payable on collection of the vehicle. CMS will be entitled to retain the vehicle until full payment of the sums due for the services performed in accordance with the repair order and any amendments thereto. In the event of repair following an accident covered by insurance, and unless there is a direct settlement agreement between CMS and the Insurance Company concerned, the customer is solely responsible for payment of the work carried out, the insurance never having with CMS of legal bonds. However, CMS remains at the disposal of the Insurance Company to provide it with any information it may need.
Article 12 – COMPLAINTS
In the event of a dispute relating to the proper execution of the work requested, the customer must notify us immediately, and put us in a position to make any useful findings. No claim will be examined after a period of two months from the date of the repair invoice. We decline all responsibility in the event of dismantling of the part or the incriminated organ without our presence. In addition, the parts, organs or assemblies sold by CMS and mounted on the vehicle are covered by the legal guarantee against hidden defects provided for by articles 1641 and following of the Civil Code. Because of this warranty, the seller is responsible for hidden defects in parts, organs or assemblies, which render them unsuitable for the use for which they are intended. In any case, the vehicle will be brought back to our workshops by the care and expense of the customer.
